These Terms and Conditions ("Terms") constitute a legally binding agreement made between you and jackfinisher.com ("Company", "we", "us", or "our") concerning your access to and use of the jackfinisher.com website and the Col. Jack R. Finisher anti-procrastination service (the "Service").
By accessing, registering for, or using the Service, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are prohibited from using the Service and must discontinue use immediately.
jackfinisher.com is a subscription-based accountability service that provides motivational communications through a fictional military character, Col. Jack R. Finisher. The Service is designed to help users overcome procrastination and thus, help boost users productivity, through a system of daily check-ins, task tracking, and feedback messages of varying intensity levels.
2.2 Service Features
The Service includes:
Initial setup questionnaire for monthly goals and daily tasks.
Daily check-ins at 18:00 hours (user's registered local time).
Response requirement by 07:30 hours the following day (user's registered local time).
Accountability messages based on performance and selected intensity level
Option to update goals, intensity level, and daily tasks at any time
You acknowledge and agree that the Service intentionally utilizes direct, blunt, and occasionally harsh language as part of its motivational approach.
Messages from "Col. Jack R. Finisher" are designed to be intensely motivational and may include creative language that some might find uncomfortable. This is an intentional feature of the Service, not a defect.
You must be at least 18 years of age to use the Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years old.
To access certain features of the Service, you must register for an account. When you register, you agree to provide accurate, current, and complete information and to update this information to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
The Service offers the following subscription options:
Basic Service: $1.99 per month (email communications only)
Premium Service: $4.99 per month ($1.99 basic + $3 for WhatsApp communications)
All payments are due in advance of the subscription period.
We accept payment via Paypal.
Prices are subject to change with 60 days' notice.
All fees are non-refundable except as required by law or as explicitly stated in these Terms.
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method for the subscription fee at the then-current rate.
You may cancel your subscription at any time by contacting customer support at [email protected] .
Cancellation will be effective at the end of your current billing period, and you will not receive a refund for the current billing period.
You agree to provide accurate information about your tasks, goals, and progress.
The effectiveness of the Service depends on honest reporting.
You agree to use the Service for personal productivity and motivation purposes only.
The Service is not to be used as a substitute for professional mental health services, coaching, or therapy.
While not legally required, the intended usage of the Service involves responding to daily check-ins.
Failure to respond will trigger escalating communications as described in the Service description.
The Service, including its original content, features, functionality, and character "Col. Jack R. Finisher," is owned by the Company and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial purposes in accordance with these Terms.
You may not:
Delete or alter any copyright, trademark, or other proprietary notices
Use the Service or any content for any commercial purpose.
Attempt to decompile or reverse engineer any portion of the Service
You retain ownership of any content you submit to the Service, including task descriptions, progress updates, and responses to check-ins.
You agree not to:
Use the Service in any manner that could disable, overburden, damage, or impair the Service.
Use any robot, spider, or other automatic device to access the Service.
Introduce any viruses, Trojan horses, worms, or other harmful material.
Attempt to gain unauthorized access to the Service or related systems.
Use the Service to harass, abuse, or harm another person or group.
Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
The Service includes a pre-qualification survey and intensity level selection to ensure appropriate use.
Option to provide reasons for non-completion with emotional check-in.
Ability to pause communications temporarily.
Regular check-ins regarding user wellbeing.
Biweekly wellness assessments.
Proactive safety mechanism based on user recent performance.
The Service employs:
Filters to prevent inappropriate or harmful content
Escalation systems based on user history and responses
Content boundaries as defined in these Terms

The Service provides:
Emergency pause functionality
Service suspension options
Follow-up protocols for at-risk users
Resource referrals when necessary
10. DISCLAIMERS
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
10.2 No Mental Health or Medical Services
THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MENTAL HEALTH SERVICES, THERAPY, MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. THE SERVICE IS DESIGNED FOR MOTIVATION AND PRODUCTIVITY PURPOSES ONLY.
10.3 Results Not Guaranteed
WE DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM USE OF THE SERVICE.
INDIVIDUAL RESULTS MAY VARY.
10.4 Communications Style
THE INTENTIONALLY DIRECT AND OCCASIONALLY HARSH LANGUAGE USED BY THE SERVICE IS A FEATURE, NOT A DEFECT. IF YOU FIND THIS COMMUNICATION STYLE DISTRESSING, YOU SHOULD DISCONTINUE USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
These Terms will remain in full force and effect while you use the Service.
You may terminate your account at any time by contacting us or using the cancellation feature in your account settings.
13.3 Termination by Us
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
Any provisions of these Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
14. CHANGES TO TERMS
We reserve the right to modify these Terms at any time.
If we make material changes, we will notify you by email or through the Service.
Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law principles.
Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the Service.
